Hereinafter, we will refer to Personaje Studio as “we” and/or “Personaje” and you as “you”, “you” and/or “User”.

The website is the portal of the Geam Awards, where users will vote for their favorite video games of each edition through the web form established for this purpose.

It is also a meeting point for gamers, developers, publishers and videogame consoles, who can participate in a private area called “Communities” where they can comment, review, carry out activities and purchase digital collectibles..

3. Acceptance

Access, registration and use of the Web Site and its contents and services implies full and unreserved adherence to the Notice set forth in the version published at the time the user accesses it.

4. Registry

In order to use certain contents and/or Services of the Website, you will need to register as a User by sending a form. 

 

Only persons over 14 years of age and/or have the authorization of your parents if you are a minor can register as a User.

The user must provide the information requested during the registration process.

User undertakes to:

• provide true, accurate and complete information about his identity, and;

• update the registration data so that they remain true, accurate and complete.

• not to use names or passwords that are offensive, offensive or that violate the intellectual or industrial property of third parties.

2. Gems

Within the Platform you will be able to obtain Gems, an internal points system, not exchangeable for money.

How to obtain gems?

By participating in Communities, reaching certain milestones or completing daily quests.

What are Gems used for?

Gems are used to:

• get discounts from collaborators, partners and brands on the Platform

• obtain digital assets, such as avatars, profile customization elements, etc.

• participate in prize draws offered by collaborators, partners and brands within the Platform

3. Site rules

The user must use the Website, its Contents and/or Services responsibly, correctly and only for personal purposes. It is forbidden:

• To carry out illicit activities, contrary to morality, public order or that harm the rights of third parties.

• Authorize third parties to use all or part of the Website or incorporate its Contents and/or Services in their own commercial activities, unless expressly authorized.

• Use technical or technological resources to exploit in an unauthorized manner the Contents, Services or the Website, with or without profit.

• Cheating

• Violate the intellectual property rights of others

• Improperly collect or distribute information.

• Upload or post illegal or inappropriate content.

User undertakes to:

• Not to damage, alter or overload equipment, computer systems or content of Personage or third parties.

• Not to use the Web Site in any way that prevents or impairs the access and enjoyment of other users.

• Not to modify Personaje's systems or use altered versions to gain unauthorized access.

• Not to interfere with or disrupt the connection of the Web Site, servers or linked networks.

Personaje assumes no liability for any failure to comply with these obligations..

4. Loss of user status..

In the event that the rules of this Notice are contravened, you will lose your user status, without prior notice and without the option of any compensation or indemnification.

Therefore, Personaje may suspend or delete your account in case of breach of the obligations and rules of conduct of the Website. 

In case of account deletion or suspension you lose all your gems.

5. Link to third parties’ websites

You may be directed from the Service to other websites through links. 

However, Personaje does not control those sites or their content, which are in fact subject to their own terms and conditions. Therefore, Personaje is not responsible for the quality, truthfulness or accuracy of those sites. 

6. Warranties and responsabilities

To the fullest extent permitted by law, Personaje and its affiliates, suppliers and distributors make no warranties, either implied or expressed, about the services. 

The services are provided on an “as is” basis. We also disclaim any warranties of merchantability, fitness for a particular purpose and non-infringement.

7. Force majeure

Notwithstanding the foregoing, Personaje shall not be liable for any delays or failures that may occur in the access, functioning and operability of the Web Site, its Contents and/or Services, nor for any interruptions, suspensions or malfunctioning of the same, when caused by breakdowns caused by natural disasters such as earthquakes, floods, lightning or fires, situations of force majeure, situations of extreme urgency such as wars, military operations, civil disturbances, strikes, lockouts or any other situation of force majeure or fortuitous cause.

The present Web Site, as well as the Content, the Services and elements that are integrated in the same one, are property or have been obtained the due authorizations for their use on the part of Personaje, being protected, without limitation, by the laws of intellectual and industrial property of the Kingdom of Spain and by the Treaties and international Agreements that could be applicable.

Personaje is the exclusive owner of all the rights of intellectual, industrial and analogous property that could fall on the Web Site.

Also, are reserved in favor of Personaje or any of its partners or collaborators, all the rights on Services, Restricted Content or elements of its property that are incorporated in the Web Site, including, to title merely enunciative and not limitative:

• those elements that make up the visual appearance, graphic image and other sensory stimuli of the web pages that make up the Website;

• the navigation architecture;

• the source codes of the web pages;

• images

• photographs;

• recordings;

• databases;

• logos, and;

• distinctive signs.

All of the above, as a whole, will hereinafter be referred to as the “Property”.

As a User, you acknowledge and accept that the Website contains accessible content and services owned by third parties whose rights are protected by the applicable legislation on intellectual and industrial property, rights to exploit the commercial and advertising value of the image and other similar rights, as the case may be.

Therefore you agree to use them in accordance with the service and not infringe the rights of Personaje or third parties.

2. Personaje’s Rights

The user acknowledges that by virtue of this Notice, Personaje does not assign or transfer to the user any rights to its Property, or to any third party properties.

Personaje only authorizes the user to access and use the same in accordance with the terms indicated in this Notice and with the functionalities of the Site.

Personaje authorizes users to access and browse the Website, using the Services and viewing the Content incorporated therein.

Users are not authorized to copy, distribute (including e-mail and Internet), transmit, communicate, modify, alter, transform, transfer or in any other way deploy activities involving the commercial use of the Website, its pages, content or elements that comprise it, either in part or in whole, without the express consent, granted in writing, of the legitimate owner of the exploitation rights. 

The access, visualization and, in its case, downloading of the Restricted Content and/or Services will always and in any case be carried out for strictly personal and non-commercial purposes.

Personaje reserves all rights over the Property including, but not limited to, all intellectual and industrial property rights it holds over the same. Personaje does not grant any other license or authorization of use to the user on its Property different from the one expressly detailed in the present clause.

Within the Website you will find various content, trademarks and services that are owned by third parties.

Personaje has reached agreements with third parties to use such materials to incorporate them into their services.

The modification, reproduction, copying, distribution or any other form of exploitation for commercial or equivalent purposes of the content and information contained in the Website is expressly prohibited.

4. User’s content

The User may participate in the “communities” section, where he/she may post messages, interact with votes, polls, write reviews or give his/her opinion regarding certain works.

In such cases, the User gives personaje a non-exclusive, worldwide, perpetual and irrevocable license on the content he/she contributes.

When you decide to give us feedback, in the form of improvements or suggestions, you grant us the right to use the idea and implement it, and you assure us that the original idea is yours.

5. Linking license

Any person wishing to link their web page to the Web Site must comply with the following conditions, unless they have prior written authorization from Personaje:

• You may not reproduce or imitate the protected content of the Website, its graphic design (“look and feel”), or make frames (“frames”) or assembled links (“link online”) of the Personaje pages.

• No false, inaccurate, denigratory statements or statements that suggest that Personaje collaborates, endorses or supervises the contents or services of the linked page may be made.

• The page that establishes the link may not include illegal, immoral or contrary to public order, or violate the rights of third parties.

Personaje reserves the right to request the elimination or restriction of any link to the Web Site, without justification.

6. Infringement notification procedure.

If you believe that there is any unlawful act or use any property without your permission, please contact us at email [email protected] with the following information:

• The name, surname, national identity document, address, telephone number and email address of the claimant, as well as, if applicable, the signature of the owner of the allegedly infringed rights or, if applicable, of the person authorized to act on his or her behalf and representation.

• Determine the alleged unlawful activity and, in particular, in the case of an alleged violation of intellectual or industrial property rights, a precise and specific description of the protected content and its exact location.

10. Validity of the notice and its modification

The legal relationship arising from access to and use of the Website, as well as the Content and Services incorporated therein, unless otherwise expressly stated, has an indefinite duration.

Any of the parties may terminate or suspend this contractual relationship unilaterally at any time and without cause other than their will, for that, as a User, you must suspend or delete the account in your profile area.

Personaje reserves the right to modify, at any time and without notice, this Notice.

11. Assignment to third parties

Personaje may assign, transfer, encumber or subrogate in favor of third parties, in whole or in part, the rights and obligations assumed by virtue of the contractual relationship herein, as well as the contractual position to any third party, it being understood by means of this clause that the user grants sufficient authorization to that effect.

12. Miscellaneous

The headings contained herein are for informational purposes only and do not affect, qualify or encourage the interpretation of the Notice, Personaje may modify the Notice in this document set forth in whole or in part.

Personaje may inform the competent authorities in case it detects any violation of applicable law or if it suspects that a crime is being committed by any of the users within the framework of the Web Site.

In addition, in the event that users breach this notice and Personaje does not take any action, it will not be considered a waiver by Personaje.

If any court declares any of the terms contained in this Notice to be invalid, such invalidity shall not affect the remaining provisions, which shall continue to apply.

13. Law and jurisdiction

The Website, including the use, registration, access and navigation on it, as well as the Services offered through it and, in particular, this Notice, shall be subject to the Spanish laws of common character and shall be interpreted and executed in accordance with them.

Users who have the status of consumers or users as defined by Spanish law and reside in the European Union, in order to try to reach an out-of-court agreement may turn to the Online Dispute Resolution Platform, created by the European Union and developed by the European Commission under Regulation (EU) 524/2013.

Also, for all disputes, actions or claims that may arise in connection with the interpretation and application of this Notice, provided that the User does not have the consideration of User or consumer, the parties submit to the jurisdiction of the Courts and Tribunals of the city of Madrid (Spain) with express and voluntary waiver of any other jurisdiction.

In the event that the User is considered a Consumer, the parties submit to the courts of the Consumer's residence.
